The Torture Memo Author- + Executive Power to Massacre- You've Never Heard Of

Recently, we were told that John Yoo and his band of merry torturers got the equivalent of a "bad dog" scolding for crafting the rules that allowed BushCo to legalize the brutalization of human beings into submission in order to get worthless testimony.

Good job, BushCo.

Now we discover that someone at OLC slipped under the radar.

Yes, there was another architect involved. Little Miss Sunshine aka Jennifer Koester, was young and new and bored and had a pile of spare time and must have been like, rilly rilly tired of posting on MySpace. What's a girl to do?

The Office of Legal Counsel remedied that. They closed their eyes, stuck out Mr. Pointer Finger, spun around, stopped, opened their eyes, and wham! Mr. Pointer was aimed directly at Lawyerette Jenny:

Though Koester was clearly the junior partner in the process, and appears to have had no authority to approve the final versions of the memos that went out from the department, it's notable nonetheless that OLC assigned the task of drafting what was essentially the government's position on the legality of torture to an attorney just two years out of law school, who appears to have been around 28 at the time. And that it did so in part because Koester, having just joined the unit, "had some time available," according to the report. It's also perhaps surprising -- given the intense level of scrutiny that Yoo has rightly received for his role in producing the memos -- that Koester has until now remained almost entirely under the radar. [...]

But the report also makes clear that, despite apparently having been given the assignment almost at random, Koester played a more active role in the process of producing the memos than perhaps anyone else at DOJ, with the possible exception of Yoo. [...]

Indeed, according to the report, it was Koester who drafted perhaps the most controversial section of the memos: the discussion of the "commander in chief" power, in which OLC essentially advises the government that the president, as commander in chief, can disregard any law he wants during wartime. "Koester also told us that she thinks she ended up writing the Commander-in-Chief section, with 'a lot of input' from Yoo and Philbin," writes OPR (p. 50).

Oh, but wait. That's not all. An internal Justice Department report released Friday revealed this little exchange:

Q: I guess the question I'm raising is, does this particular law really affect the President's war-making abilities ....

Yoo: Yes, certainly.

Q: What is your authority for that?

Yoo: Because this is an option that the President might use in war.

Q: What about ordering a village of resistants to be massacred? ... Is that a power that the president could legally--

Yoo: Yeah. Although, let me say this. So, certainly, that would fall within the commander-in-chief's power over tactical decisions.

Q: To order a village of civilians to be [exterminated]?

Yoo: Sure.


You read that correctly. Boy Georgie could order the extermination of entire villages. How WWII of them. Georgie, Yoo, and Lawyerette Jenny sure did think alike! They must have been BFF.

I wonder if Little Miss Sunshine came up with that gem, too. After all, she had more free time than everyone else did to slip in all kinds of innovative laws that rational people never would have been able to come up with.

After all, she did, per the report, draft the part of the memo that gave the "commander in chief power to disregard any law he wants during wartime."

And then, as all Lawyerettes do, she ate her P, B and J sammich, watched Barney, grabbed her blankie, and took a nap.

She slept very soundly and dreamed good dreams, because little boys and girls with no consciences never have nightmares about death and torture.

Fitz and starts

Happy News time!
Conor Patrick Fitzgerald was welcomed Dec. 21 by Chicago's U.S. Attorney Patrick Fitzgerald and his wife, Jennifer, the prosecutor's office confirmed Monday.

Fitzgerald, once a bachelor known for his long working hours, became a father at age 49.
I doubt the name Scooter was an option.

I wanted to "spit up", and wished Maddy had.

Yes, John Shadegg actually used an innocent infant as a prop, spoke baby talk, and provided us with nothing more than what was most likely in Maddy's diaper at the time. And for this, he got applause.

The collective (im)maturity of the Rushpublic side of the aisle doesn't come close to measuring up to Maddy's level of sophistication.

How utterly humiliating.

Afterthought: Did the Rushpublics start up a new recession era business... Loaner babies?

Insurance Company Agrees To Insure 'Underweight' Girl

Yesterday, we posted about this, and today? Voila!
The insurance company that initially denied coverage to a 2-year-old girl because she was "underweight" has reversed its stance.

On Wednesday afternoon, UnitedHealthcare's Golden Rule Insurance Company issued a statement that said, "As part of our standard appeals process, we undertook additional review of Aislin Bates' medical records and determined that, in fact, we can offer her health insurance coverage."
Ohhh, after their "standard" appeals process. I see. It had nothing to do with the horrendous publicity they were getting. Speaking of which...
7NEWS asked if negative publicity led to the insurance company's change of heart.

Laden said, "I would like to think not."
I bet she would like to think not. Think again, Ellen.
So how can an insurance company deny coverage? In Colorado, individual health insurance is medically underwritten. Each company has its own guidelines.

The question is are the guidelines fair and are they being used consistently?

"The individual market is a trainwreck in Colorado," said State Sen. Morgan Carroll.

Carroll said insurers can deny anybody for almost any reason.

"They can screen for anything they want and can cherrypick who they want to insure," Carroll said.

When the Commissioner of Insurance was asked about an insurance company refusing to cover underweight or overweight children, she said they could, under their own guidelines, which each company drafts.
And there you have it. "The" argument for a robust public option.

Welcome to Opposite Day, gang! First, a baby was denied coverage because he weighed too much. Now there's a healthy toddler who got rejected for not weighing enough.

But nah, we don't need to knock Big Insurance down a few pegs via a public option. That would be so socialist!
When Aislin's father, Rob, worked for another company, Aislin was covered under the company’s group health insurance plan.Now that Rob is working on his own, he's had to get new insurance. The company, UnitedHealthcare's Golden Rule, sent the family a letter, which says in part, "We are unable to provide coverage for Aislin because her height and weight do not meet our company standards."
Hey UHC's GR, you don't meet America's standards. How's that feel?

A spokeswoman for UnitedHealthcare's Golden Rule:
"Ours are based on several medical sources, including the Centers for Disease Control, and are well within industry standards," she said.Laden, who said she couldn't talk specifically about the Bates' case, added that, "When evaluating height and weight, we typically utilize other factors as well in making a decision, such as medical records that show evidence of treatment or any underlying medical conditions."
As in... pre-existing conditions? Uh-huh.
The Bates say Aislin is undergoing treatment for an active gag reflex.
So am I, after reading this article.
"It's very minor and she probably will only need therapy for a few more months," Rachel said.
Doesn't matter. Time is of the essence. Business as usual. Doesn't this family understand that Big Insurance needs to make money? How insensitive can they be? Come on, Bateses!
The Bates said Aislin is temporarily covered through COBRA, a federal program that allows people to continue an employer-based health insurance plan for up to 18 months. The parents said it costs as much to cover Aislin under COBRA as it costs to cover the remaining three family members.
I can vouch for that. We're using COBRA and paying $20,000 a year. And that will end soon, so we'll be paying someone new to screw us over very soon. Isn't this fun? See? America has the best health care ever! Just ask the Rushpublics.
"You'd never think that something like size, something that seems so irrelevant to your health, would be a discriminating factor," Rachel said.
No, you'd never think that... unless our Congress members approved it.

Unacceptable. Period. This just gave me colic:

Four-month-old Alex Lange is described as a "happy, adorable, big baby." Yet he can't get health insurance.

Rocky Mountain Health Plans refuses to cover little Alex because he's too large.

Pre-existing obesity. Oy. They're concocting ways to deny even babies health care now? As Rep. Anthony Weiner said earlier today, Big Insurance is "making our argument for us."

The Denver Post:
"I could understand if we could control what he's eating. But he's 4 months old. He's breast-feeding. We can't put him on the Atkins diet or on a treadmill," joked his frustrated father, Bernie Lange, a part-time news anchor at KKCO-TV in Grand Junction. "There is just something absurd about denying an infant."

Bernie and Kelli Lange tried to get insurance for their growing family with Rocky Mountain Health Plans when their current insurer raised their rates 40 percent after Alex was born. They filled out the paperwork and awaited approval, figuring their family is young and healthy. But the broker who was helping them find new insurance called Thursday with news that shocked them.

"'Your baby is too fat,' she told me," Bernie said.

Oh yeah? Well, their broker is too rude, insensitive, and smelly.

Bernie, Kelli, and baby Alex will be on MSNBC's The Ed Show today.

Bristol Palin and new baby "Tripp" out

MSNBC just reported that Bristol did, indeed, have her baby. She named it "Tripp".

Think back: Wasn't that one of the names we put out there as a joke?

UPDATE:

Bristol Palin, the 18-year-old daughter of former Republican vice-presidential candidate Sarah Palin, gave birth on Sunday to a healthy 7 lb., 4 oz., baby boy in Palmer, Alaska.

"We think it's wonderful," said Colleen Jones, the sister of Bristol's grandmother Sally Heath, who confirmed the news. "The baby is fine and Bristol is doing well. Everyone is excited."

The baby's name is Tripp Easton Mitchell Johnston, according to Jones.

Baby Tripp takes his surname from his dad, Levi Johnston, an apprentice electrician and former Wasilla High School hockey player who has been dating Bristol for three years.

Bristol Palin is currently residing in Wasilla and completing her high-school diploma through correspondence courses.

Johnston is studying to become an electrician. He told the Associated Press in October that he and fiancée Bristol plan to wed in 2009 and raise the child together.

Broken news: Grandpa reveals Bristol Palin’s having a boy

From the Department of Who Really Cares But It's a Slow Night:
[Chuck Heath, the father of Alaska Gov. Sarah Palin] revealed that his pregnant granddaughter Bristol Palin is having a boy and confirmed that her due date is Dec. 20. Heath said the newest Palin will be welcomed in a lime-green and yellow nursery.
Lime-green and yellow? That kid will be spitting up more often than Grandma Also says... well, "also".

They haven't picked out a name yet. Just a wild guess, but I don't think it'll be "Bob" or "Mike". They do seem to have an affinity for "Joe".

On second thought, "Joe" is way too ordinary, after the likes of Trig, Piper, Bristol, Willow, and Track. "Plumber" would seem to fit the pattern though. "Plumber Palin?" Oy. "Plumber Johnston?" (The kiddies aren't married yet.)

Heath opened up about the frenzy that ensued after his daughter became Sen. John McCain’s (R-Ariz.) running mate. He said Sarah has more than 200 media requests, including open invitations from Oprah Winfrey, Bill O’Reilly and David Letterman. He said the governor has 87 boxes of unopened mail from all over the world that the family is sorting through.
I hope Grandma Also doesn't teach little Plumber words like "in what respect" and "you betcha". But doggone it, seein' her draggin' around a new prop family member from photo op to photo op? Thanks, but no thanks.

In the near term, Plouffe will have his hands full as his wife -- former California Gov. Gray Davis adviser Olivia Morgan -- gave birth to a baby girl yesterday, the couple's second child.

The Palin baby mystery

No matter how many times I've said I'd rather not get into this, I have had a lot of readers practically beg me to post on the rumors about Sarah Palin and her pregnancy. They have linked me to various sites, so I will link you to them in turn. I will not get into details, I will not speculate or opine, nor will I post photos of her daughter. I will, however, post a the following:
