John McCain:

It would have been a serious mistake to have read the suspect in the attempted Times Square car bombing his Miranda rights, Sen. John McCain (R-Ariz.) said Tuesday.

McCain, the ranking member of the Senate Armed Services Committee and a longtime leading Republican on national security issues, said he expected the suspect in the case could face charges that might warrant a death sentence if convicted.

"Obviously that would be a serious mistake...at least until we find out as much information we have," McCain said during an appearance on "Imus in the Morning" when asked whether the suspect, 30-year-old Faisal Shahzad, a naturalized American citizen from Pakistan.

"Don't give this guy his miranda rights until we find out what it's all about," McCain added.

Pete King:

Rep. Peter King (N.Y.), the top Republican on the House Homeland Security Committee, wants to know whether the Justice Department consulted with the intelligence community.

“I hope that [Attorney General Eric] Holder did discuss this with the intelligence community. If they believe they got enough from him, how much more should they get? Did they Mirandize him? I know he’s an American citizen but still,” King told POLITICO.

Arizona is requiring U.S. citizens to carry birth certificates with them at all times. Well, not all U.S. citizens, just the ones who look...you know... "different" and fail to "answer questions correctly":

He tells 3TV, “I don't think it's correct, if I have to take my birth certificate with me all the time.” [...]

Abdon was told he did not have enough paperwork on him when he pulled into a weigh station to have his commercial truck checked. He provided his commercial driver’s license and a social security number but ended up handcuffed.

An agent called his wife and she had to leave work to drive home and grab other documents like his birth certificate.

This is a United States citizen we're talking about. In the United States. Land of the free.

And this citizen was forced to "show his papers."

Racial profiling his alive and well in Arizona.

Hard to imagine Mr Bush giving a crap about reading citizen's letters isn't it?

The letter to President Obama came from a woman in Arizona whose husband lost his job. He was able to find work, but the new gig came with one-third the pay; the family is struggling to make their mortgage payments.

This was one of the biggest wastes of the Supremes' time and energy that I can imagine. And an even bigger waste of time will be that spent by those who will continue to make every effort to de-legitimize Obama's presidency using this baseless drivel as the excuse.

Oh, and those who are so hellbent on perpetuating this baloney? Start watching the video at about 2:12. That's where Pete Williams says that "there are a number of legal scholars who say that the question of John McCain's citizenship actually was a more interesting legal matter."

Oy. As Jerry Seinfeld would say, "Who a-a-are these people?"

A small but determined band of conservative protesters gathered outside the Supreme Court Friday morning to pray the justices would invalidate Barack Obama's election.

The court was deciding whether it would hear oral arguments in Donofrio v. Wells, which argues that Obama's placement on the New Jersey presidential election ballot was invalid because he is not a natural born citizen. The justices are expected to dismiss the case.

Discussions with several of the 18 demonstrators who gathered despite freezing temperatures revealed disjointed, confusing and increasingly conspiratorial reasons for their presence. Several alleged varying degrees of a cover-up to hide the circumstances surrounding Obama's birth; none were willing to accept the much simpler explanation that Obama was in fact a natural-born citizen eligible to be president. [...]

To be clear, the questions of Obama's birth have been roundly and convincingly debunked.

The citizenship questioners organized on fringe Web sites and through YouTube videos. Several questioned why the mainstream media wasn't covering their conspiracy-mongering.

Pete Anderson, a retiree from Springfield, VA, spun a theory involving "staged backpack nukes already in this country" that were somehow involved in preventing the media from reporting on Obama's citizenship.

"There is a theory -- as crazy as it may seem -- that we are now in a state of siege," Anderson said.

It was tough to follow Anderson's logic, and even fellow demonstrators thought it was too far out there.

"I didn't bring my tinfoil hat," Bredow ribbed, cutting into our interview.

The two demonstrators went on to bicker between themselves over the true reasons for the media's silence.

I've posted about this previously. Every single legal mind on the Tee Vee Machine has literally bet anything from their reputations to their "vast wealth" (said kiddingly by Jeff Toobin) that the Supremes will throw this time-wasting excuse for a case out on Monday.

Obama Is Eligible For His Job. He is a natural born U.S. citizen. Okay? Okay.

Well, his birth certificate is valid, for one thing; it's survived scrutiny and has been sanctioned as valid by the legal authority empowered to sanction such things. A conspiracy to cover this up is -- would be -- preposterous.

A thinner version of the claim holds that Obama is a citizen, but not a natural born or naturalized citizen and this constitutionally ineligible. This claim rests on a fairly tendentious argument about Obama's father and mother. Obama Sr., wasn't a citizen; therefore, his son could not have been born to two U.S. citizens; to be a naturalized citizen, both parents have to be U.S. citizens. Also: the law requires citizen-parents to have spent a certain length of time in the state; Obama's mother was a woman of the world.

But the two-citizen parent rule, which is no longer in effect, applied to people born outside the U.S. Obama was born in 1961 in Hawaii, a U.S. state since 1959; (had he been born earlier, it wouldn't matter -- U.S. law granted natural born citizenship to every Hawaiian born after 1900.)

Now -- the 14th amendment is fairly clear on the subject:

All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.

A further objection: to be "natural born," as the constitution requires, is to be born on U.S. soil (check) to two citizen parents (x mark.) Again -- that claim has no basis in federal law, Supreme Court precedent, or English common law.

To all those desperate souls who can't stand the notion of a President Barack Hussein Obama, you're plum out of luck. He won by a landslide, he has a mandate, and he is an honest-to-goodness U.S. citizen who easily qualifies for the position.

We're done now.

Say Buh-Bye to Idiotic Republican Obama Birth Certificate Lawsuit

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

Philip J. Berg alleged in a complaint filed in federal district court on Aug. 21 against Obama, the Democratic National Committee and the Federal Election Commission, that Obama was born in Mombasa, Kenya.

Berg claimed that the Democratic presidential standardbearer is not even an American citizen but a citizen of Indonesia and therefore ineligible to be president.

He alleged that if Obama was permitted to run for president and subsequently found to be ineligible, he and other voters would be disenfranchised.

U.S. District Judge R. Barclay Surrick had denied Berg’s request for a temporary restraining order on Aug. 22 but had not ruled on the merits of the suit until yesterday. [...]

In a 34-page memorandum and opinion, the judge said Berg’s allegations of harm were “too vague and too attenuated” to confer standing on him or any other voters.

Surrick ruled that Berg’s attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were “frivolous and not worthy of discussion.”

The judge also said the harm Berg alleged did “not constitute an injury in fact” and Berg’s arguments to the contrary “ventured into the unreasonable.”

To all the Commenters who have been asking about it, that should finally put the matter to rest.
